vis major : irresistible force; such an interposition of human nature and agency as is from its nature and power absolutely uncontrollable; eg, the inroads of a hostile army, or forcible robberies, may relieve from liability from contract. JBS. ● As a ground for seeking the assistance of a court of equity, accident means not merely inevitable casualty, or the act of God, or, as it is called, vis majeur, but also such unforeseen events, misfortunes, losses, acts, or omissions as are not the result of negligence or misconduct. inevitable accident : An accident that cannot be avoided by the use of ordinary care, caution and skill. Where such inevitable accident is due, directly and exclusively and without human intervention, to natural causes against which no human foresight could provide, it is termed an Act of God. Inevitable accident can be a defence to an action of negligence. JBS. ●
